Wrongful Death Lawsuit Filed Against Kaiser’s Troubled Northern California Kidney Transplant Center

Sacramento, CA – May 11, 2006 (PRN): Today a wrongful death lawsuit along with two individual personal injury actions was filed against Kaiser Permanente in Alameda County Superior Court. The lawsuit alleges that due to numerous bureaucratic problems with Kaiser?s troubled Northern California kidney transplant center, the plaintiffs were not placed on the national kidney transplant list and did not receive kidneys that became available during this time period. In one case, the plaintiff alleges that the delays caused by Kaiser resulted in her husband?s death. In the other two cases, the plaintiffs seek damages associated with prolonged kidney dialysis and the health consequences associated with the failure to obtain a kidney when one was presumably available.

Kaiser?s Northern California transplant center was opened in 2004 and, at that time, approximately 2,000 individuals who were on transplant waiting lists at outside transplant centers were forced to transfer their names onto Kaiser?s transplant list. However, recent media reports have revealed that Kaiser was woefully unprepared to handle such a large influx of patients. As a result, patients? medical records were lost, calls from patients went unreturned for months, and patients were not placed on the national kidney transplant waiting list. These problems resulted in many patients not receiving kidneys that they otherwise would have received had they not been forced onto Kaiser?s waiting list.

Sacramento attorney, Stuart Talley, reported: ?This is just the beginning. Since news of the problems at Kaiser?s transplant first surfaced, we have been bombarded with phone calls from Kaiser patients who have been given the run around for the past two years. The stories of the poor care and bureaucratic blunders are simply unbelievable. These people are some of the most vulnerable in our society and were counting on Kaiser to take care of them. We expect to be filing many more lawsuits within the next few weeks.?
